"The civil code is an organic body of provisions of civil law, but not only that, since it also contains rules of civil procedural law of general importance (e.g. book VI - title IV) and some incriminating rules (e.g. book V - title XI). It constitutes, together with the Constitution of the Italian Republic and the special laws, one of the sources of civil law.
The civil code currently in force in Italy (approved with Royal Decree 16 March 1942, n.262), which replaced that of 1865, is the Code issued in 1942 and contains significant differences compared to the model of the French and Italian tradition of the nineteenth century. In addition to this tradition, it is also influenced by another, more recent model of civil code, which had an extraordinary importance for the evolution of Italian legal science in the first half of the twentieth century: the Bürgerliches Gesetzbuch of 1900.
The civil code of 1942 has a unique peculiarity among contemporary European civil codes: it contains both the discipline of civil law and the discipline of commercial law, which were previously dictated in two different codes."
